[신문고] 이계덕 기자 = 아시아 인권위원회가 세월호 참사와 관련해 "한국에 무기력과 사기저하가 사회에 인식되지 못한 채 퍼져나가고 있다"며 "이 고통은 국가가 국민들의 생명을 보호하지 못한 실패에서 기인하고 있다"고 분석했다.
 
이어 "대한민국 국민들에게 이러한 무기력과 사기저하에서 벗어나기 위해서는 국민들의 생명을 보호하지 못하고 변명에 급급한 국가와 정치를 바꾸기 위해 국민들이 직접적으로 나서야 한다"고 해법도 제시했다.
 
<뉴스프로>에 따르면 아시아 인권위는 이날  '세월호와 함께 침몰한 국민들의 사기(SOUTH KOREA: Ferry Sinks National Morale)'라는 제목의 성명서를 통해 "대중들은 국가가 국민들을 보호하고 그 대신 국민들은 중요한 기관들이 그들의 안전을 보장하기 위해 기능을 발휘할 수 있도록 세금을 내는 것이라 생각해왔고 국가는 부를 공평하게 배분하고 소외계층을 보호하기 위해 단호한 조치를 취한다는 기대와 약속이 있었지만 세월호 사건 후 이러한 생각과 기대들은 부서졌고 많은 이들은 이제 국가의 역할에 의구심을 갖고 있다"고 전했다.
 
이어 아시아인권위는 "선장과 승객, 그리고 해경 등의 무책임한 대처가 국민들의 분노를 깊게 했다"며 "특히 주요방송 언론들과 기자들은 거짓된 정보를 방송과 구조활동을 조작했고 가족들의 목소리는 외면하는 등 언론의 왜곡이 국민들의 분노를 확대시키고 가속시켰다"고 지적했다.
 
또 "내적 사기저하가 자신의 정부에 의해서 상처받고 배신당한 국민적 기억으로 반복되고 있다"며 "과거의 경험으로부터 교훈은 유사한 사건들의 재발을 막기 위해 현재와 미래 세대에게 가르쳐져야 한다"고 덧붙였다.
 
아시아 인권위는 "사고의 이면에 있는 진실은 그 첫 번째 단계이고 희생자 가족들은 진실을 알 권리가 있다"며 "세월호 특별법이 유가족들의 수사권과 기소권 포함 요구에도 불구하고 정부여당은 미로같은 정치적 절차를 피난처로 삼고 있다"고 지적했다.
 
이어 "인류의 역사의 모든 국면은 자신들의 정치권력을 지키기 위해 변화를 받아들이기 주저했던 반대편의 인물들로 어지럽혀져 있다"며 "정의는 주어지는 것이 아니라 고취된 의식을 지닌 사람들이 성취하는 것"이라고 덧붙였다.

세월호와 함께 침몰한 국민들의 사기

On April 16 of this year, a ferry sank and hundreds of lives were lost. Many students who died were from a single school. Dozens of passengers are still missing. This incident has signalled the public that they need to be more aware of the concept of ‘safety’. Analysis from experts and the media has contended that structural flaws caused the ferry to sink. According to them three reasons were operative in the sinking. First, the ferry was carrying overweight containers that were not properly fixed to the deck. Second, there was illegal renovation of the ferry, plus the failure of supervising authorities to inspect the ship adequately. Third, the control centre was negligent in monitoring ship movements in the adjacent seas. And, in addition, there were failures by the marine police, a government institution, during the course of rescue activities.

올해 4월 16일, 여객선이 침몰해 수백 명이 목숨을 잃었다. 사망한 학생들은 대부분 같은 학교 학생들이었다. 승객 10여 명은 아직도 실종 중이다. 이 사건은 대중들에게 ‘안전’ 개념을 좀더 인식해야 한다는 필요성을 일깨우는 계기가 됐다. 전문가들과 언론의 분석은 구조적인 과실들이 여객선 침몰을 유발했다고 주장한다. 그들에 의하면 세월호 침몰에는 세가지 이유가 작용했다. 우선, 여객선은 갑판에 제대로 고박하지도 않은 채 너무 많은 화물을 싣고 있었다. 둘째로, 여객선에 불법적인 개조가 행해졌고 이에 더해 감독기관은 선박에 대한 적절한 조사를 하지 않았다. 셋째, 관제센터는 인근 해상에서 선박의 움직임을 감시하는 데 태만했다. 또한 정부 기관인 해경은 구조활동을 진행하는 과정에서 과오가 있었다.

One factor that has received less attention in this tragic incident is the chronic disease it has spawned, something unaddressed by society. This affliction is none other than the consummate demoralisation of the people as a whole, which stems from the failure of the state to protect the lives of its citizens. The public had assumed that the state provides protection for citizens and, in return, citizens pay taxes so vital institutions may function to ensure their safety. The expectation and promise was that the state distributes wealth equally, taking affirmative action to protect the marginalized. However, after the ferry incident, these assumptions and expectations have taken a hit; many now doubt the state’s role.

이 비극적인 사태에서 관심을 덜 받아온 한 가지 요소는 사회에서 인식되지 못한 채 퍼져가고 있는 만성질환이다. 이 고통은 다름아닌 국가가 국민들의 생명을 보호하지 못한 실패에서 기인한 국민 전체의 무력한 사기저하다. 대중들은 국가가 국민들을 보호하고, 그 대신 국민들은 중요한 기관들이 그들의 안전을 보장하기 위해 기능을 발휘할 수 있도록 세금을 내는 것이라 생각해왔다. 국가는 부를 공평하게 배분하고 소외계층을 보호하기 위해 단호한 조치를 취한다는 기대와 약속이 있었다. 하지만 세월호 사건 후, 이러한 생각과 기대들은 부서졌고 많은 이들은 이제 국가의 역할에 의구심을 갖는다.

The ferry captain was in a position to see the position of the ferry as it sank. He repeatedly ordered passengers to remain inside the vessel until rescue teams arrived. But, it was the captain who, with a few other crew members, abandoned the ship first. He did not take the steps needed to rescue the passengers. And, his actions provoked outrage on the part of family members. The level of outrage deepened when the authorities, especially the marine police, failed to take appropriate steps to rescue passengers as the ferry was sinking. And, the main broadcasting media outlets and journalists broadcast false information. In addition, they fabricated rescue activities. Due consideration was not given to the voices of family members. These actions escalated and accelerated the outrage of the people. Not only were families and relatives of the victims affected, the society as a whole suffered as it witnessed the state in action.

여객선 선장은 여객선이 침몰할 때 여객선의 상태를 살펴야 하는 위치에 있었다. 그는 계속해서 승객들에게 구조팀이 도착할 때까지 배 안에 있으라고 지시했다. 하지만 몇 명의 선원들과 함께 배를 제일 먼저 버린 것은 다름아닌 선장이었다. 그는 승객들을 구조하는 데 필요한 조치를 취하지 않았다. 그래서 그의 행동은 가족들의 편에서는 분노를 자아냈다. 여객선이 침몰하고 있을 때 당국, 특히 해경이 승객들을 구하기 위해 적절한 조치를 취하는 데 실패했을 때 분노의 수준은 깊어졌다. 그리고, 주요방송 언론들과 기자들은 거짓된 정보를 방송했다. 또한, 그들은 구조활동을 조작했다. 가족들의 목소리에 대한 정당한 배려는 주어지지 않았다. 이러한 행동들은 국민들의 분노를 확대시키고 가속시켰다. 이러한 국가의 행동을 목격하면서 가족들과 친지들뿐 아니라 사회 전체가 고통 받았다.

This tragedy requires more analysis to better understand the perspective of social demoralisation. In fact, the ferry incident is not an isolated one, if we consider the modern history of Korea. When the North Korean army invaded the South on 25 June 1950, President Lee, the first President of the Republic of Korea, with full knowledge of the circumstances, repeatedly broadcast this message to the people of Seoul. He said that the South Korean army was fighting back the North Korean army. The people of Seoul had nothing to worry about. But, in fact, President Lee was the first one to abandon Seoul. He settled down in the relative safety of Daejeon at the break of dawn on 27 June. The Minister of National Defence was the second to escape that afternoon, followed by the Army Chief of Staff the following dawn.

사회적인 사기저하의 개념을 더 잘 이해하기 위해 이 비극은 더 많은 분석들이 필요하다. 우리가 한국의 현대사를 고려한다면 사실 여객선 사건은 동떨어진 것만은 아니다. 1950년 6월 25일, 북한 군대가 남한을 침략했을 때 한국의 초대 대통령 이승만은 상황을 제대로 인식하고 있음에도 서울 시민들에게 계속해서 같은 메시지를 방송했다. 남한군이 북한군을 반격하고 있다, 서울 시민들은 아무 것도 걱정할 것이 없다고 그는 말했다. 그러나 사실 이 대통령은 서울을 최초로 버린 사람이었다. 그는 6월27일 새벽에 상대적으로 안전한 대전에 안착했다. 국방부 장관은 그 날 오후에 두 번째로, 그리고 육군참모총장이 뒤이어 다음 날 새벽 탈출했다.

Until that day, the broadcasting continued. Soon after the Army Chief abandoned Seoul, an order was given to blow up the bridges over the Han River, which flows from east to west across the country. It was reported that 500 innocent civilians who were crossing the bridges at that time were killed, not by the North Korean army, but by their own military.

그날까지 방송은 계속되었다. 육군참모총장이 서울을 버린 직후, 한국의 동쪽에서 서쪽으로 흐르는 한강 위에 놓인 다리를 폭파하라는 명령이 내려졌다. 바로 그 시간 다리를 건너고 있었던 500명의 무고한 시민들이, 북한군이 아니라 그들 나라의 군에 의해, 죽임을 당했다고 한다.

This historical fact was not properly reported and considered due to the Korean War, which wrought hundreds of thousands of human casualties and took three years to reach an armistice. As a result, the head of state, together with those responsible for relinquishing their duties, were not only freed from responsibility, but President Lee continued to rule the country for the following 12 years.

이 역사적인 사실은, 수십만 명의 사상자를 초래하고 휴전에 이르는 데 3년이 걸린 한국전쟁 때문에 제대로 보도되지도 고려되지도 않았다. 결과적으로, 그 국가수반은 자신들의 임무를 포기한 자들과 함께 책임에서 자유로웠을 뿐만 아니라, 이 대통령은 그 후로도 12년간 계속해서 한국을 통치했다.

The failure to hold them responsible has been explained away with the excuse that it was a transitional period (from the mindset of monarchy to that of a republic), with a high level of prevailing illiteracy, and total control of the media.

그들에게 책임을 묻지 못한 것은 (군주제의 사고방식에서 공화제의 의식구조로) 바뀌는 과도기였고 전국적으로 문맹률이 높고 철저한 언론 통제가 이뤄지던 시절이었다는 구실로 해명되어왔다.

Such excuses no longer explain the contemporary situation. But the inner demoralisation repeats itself as a national memory of being hurt, of being betrayed by ones own government.

이러한 변명들은 더 이상 이 시대의 상황을 설명해주지 못한다. 하지만 내적 사기저하가 자신의 정부에 의해서 상처 받고 배신당한 국민적 기억으로 반복되고 있다.

Lessons from past experiences should be taught to current and future generations to prevent similar incidents from re-occurring. The truth behind the ferry incident is the initial step, and families of the victims have the right to know the truth.

과거의 경험으로부터 교훈은 유사한 사건들의 재발을 막기 위해 현재와 미래 세대에게 가르쳐져야 한다. 선박 사고의 이면에 있는 진실은 그 첫 번째 단계이고, 희생자 가족들은 진실을 알 권리가 있다.

Symbolic actions are mere political gesture. They include the resignation of the Prime Minister – who, incidentally, was re-hired in a couple of months – and the abolition of the marine police. The actions were taken only to avoid and mitigate the fallout in the intense period of criticism following the sinking.

상징적 조치들은 정치적 제스처일 뿐이다. 국무총리-어쩌다보니 두어달 후 재임용된-의 사임과 해경의 해체 등이 그러한 예에 속한다. 그 조치들은 선박 침몰에 따른 비난이 집중된 시기에 좋지 못한 결과들을 피하고 완화하기 위해 취해진 것들일 뿐이다.

Three months after the tragedy various stakeholders have agreed to introduce a special law that will authorise an inquiry into the truth of the ferry sinking. No agreement has yet been reached in terms of the contents of the bill. According to the ruling majority party, the draft bill shall not involve any vesting of investigatory or prosecutorial power. The opposition feels only investigatory power should be allowed. Civil society and the families of the ferry victims are demanding both. Once again, the decision makers are taking refuge in the labyrinths of the political process.

참사 세 달 후, 여러 이해관계자들이 선박 침몰 진실의 조사를 인가하는 특별법의 도입에 동의하였다. 법안의 내용에 대해서는 아직 어떠한 합의에도 이르지 못했다. 집권 다수당에 따르면, 법안의 초안은 어떠한 수사권이나 기소권의 부여가 포함되지 않을 것이다. 야당은 수사권만이 허용되어야 한다고 생각한다. 시민단체와 여객선 희생자 유가족들은 둘 다 요구한다. 또 다시, 결정권자들은 미로 같은 정치적 절차를 피난처로 삼는다.

If the system of representative democracy had been functioning well then proper measures would already have been taken, regardless of party allegiance. As demonstrated by this tragedy, and from what we know is going on in South Korea, it appears that representative democracy is heading for another failure. The citizens are on notice that they are only needed as an electorate during an election period.

대의민주주의 제도가 잘 작용하고 있었다면 정당에의 충성과 관계없이 적절한 조치가 벌써 취해졌을 것이다. 이 비극으로 입증되었듯이 그리고 한국에서 일어나고 있는 일들에서 알 수 있듯이, 대의민주주의는 또 다른 실패를 향해 가고 있다. 시민들은 그들이 선거기간 중에 유권자로서만 필요로 한다는 것을 통보받았다.

In the long run, a change needs to be made to amend and create a more responsible representative regime. This is the time for the public to open the gates to trigger such changes. The ferry incident is a tragedy in the extreme, but the South Korean society now has another chance to correct some of its problems and get it right.

결국에는 더욱 책임감 있는 대의 정권을 창조하고 수정하기 위해 변화가 필요하다. 국민이 문을 열고 이러한 변화를 촉발시킬 때이다. 여객선 사건은 극단적인 참극이지만 한국 사회가 일부 문제점을 고치고 제대로 할 수 있는 또 다른 기회이다.

In line with the demands of the families of the ferry victims and civil society, the Asian Human Rights Commission adds its voice. All phases of human history are littered with opposition figures reluctant to accept change in order to secure their power in politics. But history teaches that change is possible with the majority of people. Justice is not something given but something achieved by people with heightened consciousness.

여객선 희생자 유가족과 시민단체의 요구에 아시아 인권위의 목소리를 보탠다. 인류 역사의 모든 국면은 자신들의 정치권력을 지키기 위해 변화를 받아들이기 주저했던 반대편의 인물들로 어지럽혀져 있다. 그러나 역사는 변화가 대다수의 사람들과 함께 가능하다고 가르쳐준다. 정의는 주어지는 것이 아니라 고취된 의식을 지닌 사람들이 성취하는 것이다.

Indeed, society is deeply demoralised by those running government institutions. But, it is the ordinary people, acting with humanity, who can reclaim hope and begin curing society. Otherwise, only a national memory of betrayal will be repeated.
확실히 사회가 정부기관을 운영하는 사람들로 인해 사기가 크게 저하됐다. 그러나, 인륜에 따라 행동하는 평범한 시민들이야말로 희망과 사회 치유의 시작을 되찾을 수 있다. 그렇지 않다면 단지 배신이라는 국민적 기억이 반복될 것이다.
